Online Portrait Session Contract - Lake Charles Portrait and Landscape photographer Bart Leger

The contract below was created to ensure all clients know exactly what a photography session with Bart Leger entails and to guarantee that client and studio expectations are met. Please read the entire contract carefully, digitally sign and submit prior to the start of your portrait session. Do not hesitate to call with questions and thank you kindly for your business!

    The signing of this contract states the client's understanding that it is their choice to participate in this session, and that the client will not hold studio responsible for any negative actions or feelings that may commence due to the images of this shoot. By submitting this contract, the client agrees to the terms, conditions, and timeline of the session, and the delivery of images and products. The client states that they are 18 years or older. If the client is not 18 years or older, it is understood that a parent or legal guardian is required to sign this contract as well.

    This signed contract and 50% of the total package cost are required to book any session or package. The remainder of the package amount is due the day of the scheduled session, prior to the start of shooting. In the event of a canceled session this deposit is non-refundable. The studio reserves the right to refuse services/products if the payment arrangements have not been met unless prior arrangements have been made.

    Payment Stipulations:
    There is a $25 fee for any returned checks. In the event of a previous returned check by client, studio reserves the right to refuse payment of checks in the future. Sessions, design progress and printed orders will not be commenced until payment has been received and processed in full.

    Schedule Arrangements:
    All sessions will start at the scheduled time even if the client is tardy or unprepared. The session end time will remain the same. If additional time is needed, client will have the option to pay for additional time at an hourly rate. If more than one location is used in a single session, the travel time does not count towards the total session time. The same applies for outfit changes. The client is responsible for providing any props or outfits that are to be used within the session. Studio will not be held responsible for additional sessions needed due to forgotten items. If client is late or more than fifteen minutes late without a phone call, Bart Leger reserves the right to reschedule.

    Additional Fees:
    In the event that the client specifies a certain shoot location, the client is responsible for all location fees involved such as access fees, parking, etc. Client is also responsible for arranging the location access and any permits/passes related to doing so. There are additional fees for the following: added time or any products/prints/services not specified in the package purchased.

    Bart Leger is not held responsible for behavior of parties involved with the shoot, with the exception of studio personnel. If the desired outcome of your session is jeopardized by the behaviors of parties involved with the exception of studio personnel, Bart Leger cannot be held responsible. We understand children aged newborn-one year can be particularly difficult. We reserve the right to suggest session rescheduling if progress is not achieved within the first 15-20 minutes of session.

    Client Usage Rights/Copyrights:
    The photographs produced by Bart are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without explicit written permission. It is a breach of this contract to reproduce the images in any form unless rights were purchased within the package for those images. Client reserves the right to share images previously posted by photographer on social networking sites such as Facebook and Twitter. It is a breach of this contract to crop/hide studio logo. Photographer agrees to grant these image rights to the client with a non-exclusive, limited, perpetual license. This license allows the client to do the following with the images: i) Display the images; ii) Print the images; iii) Upload, email, or electronically transfer the images or files; and, iv) Publish the images on personal websites or social media websites.

    This license will prohibit the client from doing the following:

    Applying for copyright registration or selling of any image or electronic files supplied by photographer.

    Making 'derivative works' or otherwise modify, including editing and/or manipulating electronic files.

    Model Release:
    Client grants to Photographer and his legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of Client, Client's child or children, or in which Client may be included for editorial, trade, advertising and other purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. Client hereby releases Photographer and his legal representatives and assigns from all claims and liability relating to said photographs.

    Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. In the event of a cancellation or postponement of the portrait session/agreement by Client, initial fees paid are non-refundable. Deposits are transferable if a date change is necessary. Forty-eight hours (48) notice of postponements or cancellations is appreciated. If it is not possible for a session to take place on a scheduled day due to weather, Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.

    Limit of Liability:
    In the unlikely event that the photographer is injured or becomes too ill to photograph the session, a reshoot will be scheduled for the next available time slot. Although care will be taken with digital files, the photographer limits any liability for loss, damage or failure to deliver photographs for any reason of photographers non-performance caused by any force or similar circumstances, illness, accident or any cause beyond their control.

    All images will be backed up and archived for a reasonable length of time. After one year, it is understood that images will continuously be kept in archives but photographer cannot be held liable for unexpected loss, damage or quality loss of session images.

    Creative Privilege:
    By scheduling a session with our studio, you agree to the creative liberties and style Bart Leger chooses to pursue. There are times in which an image needs a certain crop or a particular treatment. Bart Leger will do his best to suit your tastes, but retains the freedom to take creative liberties in order to deliver the best possible image.

    Bart Leger does offer stylized photography options. Upon request, we can help choose client clothing, accessories and session props. Clients looking to obtain the best possible images from their scheduled photography session, are simply asked to trust our judgments and suggestions to help ensure the desired results.

    In the unlikely event that Client is completely dissatisfied with the final results, Photographer will reshoot the session at no additional charge one time. Re-shoots are determined at the discretion of the photographer. Re-shoots will not be offered for poor choices in clothing, make-up, hair, weather related and behavioral issues or events that are beyond Photographer's control.

    Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against the person and their business.

    Session requests:

    • - No cameras/camcorders/any type of recording device (this includes cell phones) are allowed during the session.
    • - Sessions start at agreed upon time. It is strongly encouraged for clients to arrive 15 minutes prior to the start of the session. In the event of a delay, please notify the photographer.
    • - Arriving late will cut into your contracted session time.
    • - Please do not bring children who are not being photographed to the session.
    • - Please avoid snacks that stain teeth and clothing.

    Independent Contractor:
    This Contract is not to be construed as an employment agreement in any way. The Photographer functions as an independent contractor.

    Entire Agreement:
    This agreement contains the entire understanding between Photographer and Client. It supersedes all prior agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, it does not mean that any other provision is also waived. This constitutes an order for one portrait session with Bart Leger, Photographer.
